Beetle zone fouls alleged; Log movers taken to court.

Byline: Scott J. Croteau

WORCESTER - Three tree companies are accused of violating the quarantine for Asian longhorned beetles Noun 1. Asian longhorned beetle - a beetle from China that has been found in the United States and is a threat to hardwood trees; lives inside the tree; no natural predators in the United States

by moving logs out of the regulated area. They could all face state or federal charges, or both.

Maj. John S. Pajak, chief of the Inland Enforcement Bureau of the Massachusetts Environmental Police, said one local company will be taken to court today in Worcester for a clerk magistrate's hearing.

The three companies facing charges of violating the quarantine have been suspended from working in the restricted zone, which covers Worcester and parts of West Boylston, Boylston, Shrewsbury and Holden. The state Department of Conservation and Recreation took the action against the companies.

company that allegedly moved trees out of the quarantine zone to Rhode Island could face federal charges, Maj. Pajak said.

"We've been called repeatedly by the task force," Maj. Pajak said. "The subject we've been called for is violation of the quarantine."

All three companies had gone through training and signed a consent agreement to work within the quarantine zone and properly dispose of the wood.

The company going before a magistrate today is accused of moving loads of logs out of the quarantine zone into southern Worcester County Worcester County is the name of several counties in the United States of America:

.

Maj. Pajak did not disclose the names of any of the companies because they have not been formally charged and the investigations, which started in early October, are continuing.

A couple also were found in violation of the quarantine regulations after an investigation, but authorities declined to formally charge them and instead had them attend a training and orientation session about the Asian longhorned beetle.

A proposed law would attach criminal penalties to violations of the Asian longhorned beetle quarantine through the state DCR DCR Department of Conservation and Recreation

. Currently DCR fines are limited to $25 per violation. The proposed law would increase the penalty to $25,000 and one year in prison.

Maj. Pajak said that in the cases of the three tree companies, authorities are using a state criminal law that addresses crimes against property and bringing pests into a state. The law states anyone transporting from one town to another pest eggs, nests, larvae Larvae, in Roman religion

or pupae - except while involved in research - and those who violate quarantine regulations can be fined $200, sent to jail for two months or both.

People can be arrested for violating the law. Maj. Pajak said restitution also can be ordered. He noted that when logs are moved out of the quarantine zone, the environmental police, along with inspectors from the beetle eradication task force made up of officials from Worcester, the U.S. Department of Agriculture and the state DCR, have to ensure all the logs are returned to the quarantine zone.

Authorities also have been in contact with the state police Commercial Vehicle Enforcement Unit, Maj. Pajak said. Companies violating the quarantine zone could have their commercial licenses and license plates revoked.

The law: Live beetles, firewood, lumber or any infested host tree branch, twig, stump or other woody material cannot be moved out of the area. The beetles consume several varieties of trees, including maples.

The schedule: See Page A8 for where inspectors will be this week.
