Batesville trucking firm files lawsuit over fire.


A Batesville trucking company charges that a defective defective adj. not being capable of fulfilling its function, ranging from a deed of land to a piece of equipment. (See: defect, defective title)  design in a Kenworth Truck Co. vehicle started a fire in October that caused more than $230,000 in damage.

 Trucking Inc., which is in Chapter 11 bankruptcy bankruptcy, in law, settlement of the liabilities of a person or organization wholly or partially unable to meet financial obligations. The purposes are to distribute, through a court-appointed receiver, the bankrupt's assets equitably among creditors and, in most  reorganization, said that in October, one of its employees parked a 2007 model truck it bought from Paccar Inc. of Bellevue, Wash., which does business as Kenworth, according to according to

The employee then left Bill Davis' parking lot and the truck caught fire, also causing damage to another one of Bill Davis' 2007 Kenworth trucks, which was parked next to it, the lawsuit said.

"The cause of the fire was the defective design and installation of the battery cable," the lawsuit said. The fire caused $236,070 in damage.

Bill Davis is suing for negligence and breach of expressed and implied warranties A promise, arising by operation of law, that something that is sold will be merchantable and fit for the purpose for which it is sold.

A Paacar spokesman was unavailable for comment.

Bill Davis Trucking filed for Chapter 11 bankruptcy protection in 2007. On May 31, 2009, Bill Davis Trucking reported assets of $1.9 million and liabilities of $755,700.

In May, the trucking company listed revenue of $1.1 million but posted a loss of $26,300. In April, it had revenue of $1.07 million and a profit of $37,000.

Bill Davis was unavailable for comment last week.
