Bar Code User Granted Stay in Lemelson Suit Pending Outcome of Intermec Action.

A federal judge in Phoenix recently placed a hold on litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

 by the Lemelson Limited Partnership (Lemelson) against a bar-code user pending the outcome of a suit filed against Lemelson by Intermec Technologies Corp. and six other bar-code manufacturers.

"We support Judge Holland's decision in Arizona and believe other bar-code users are entitled to similar relief," commented Intermec President Bob O'Malley.

"Our suit last summer raised important questions about the validity of the Lemelson patents. It is fair and appropriate for customers to petition the court to seek a similar hold on Lemelson's actions until the larger question of patent validity can be resolved. Then, finally, our industry can resolve these legal issues."

) company, together with six other bar-code companies (a), sued the Lemelson Foundation in federal court in Reno, Nev., seeking a declaration that certain Lemelson patents are invalid, unenforceable and not infringed.

Lawyers representing Lemelson filed a motion to dismiss the Intermec suit; that motion was denied in March of this year. On April 14, 2000, Lemelson filed suit against 438 bar-code users in federal court in Phoenix, attempting to pressure them into settlements.

Like the customer that won a hold in the Phoenix court on Lemelson's action, each of the remaining companies has the right to ask for a similar "stay" decision.
