BANKING AND THE CRA See Community Reinvestment Act.  

In addition to the difficult Southern California real estate market and overall economy, banks are facing the additional challenge of meeting the very detailed internal control and compliance requirements resulting from the passage of the Federal Deposit Insurance Corporation Federal Deposit Insurance Corporation (FDIC), an independent U.S. federal executive agency designed to promote public confidence in banks and to provide insurance coverage for bank deposits up to $100,000.  Act as well as the Fairness Requirements of the Community Reinvestment Act Community Reinvestment Act (CRA)

"The CRA requires depository institutions to help meet the needs of minorities and the poor in the communities they serve," noted Richard Thomas, partner in Deloitte & Touche banking practice. "Until recently, CRA compliance was measured by a bank's efforts to reach out. Now, compliance is being measured by results, which is a particular problem for ethnic and minority banks. That is why we are participating in a minority bank/CRA issues conference with the National Association of Chinese American Bankers on September 29th."

DERIVATIVES

Derivatives have become a pervasive and controversial force in the financial risk management of virtually all business. Negative publicity about derivatives has been rampant in recent months. Financial risk management products that are effective when properly controlled, now have the stigma of dread, deceit and disaster. "In most cases, there is nothing sinister about the way derivatives are utilized," noted Angelia M. Doerner, partner and designated financial instruments specialist at Deloitte & Touche. "Unfortunately, in many instances, companies don't have the expertise or the policies and procedures to properly manage and control the complexities of today's products." Doerner noted that Deloitte & Touche is working with the National Association of Corporate Directors in presenting a series of workshops for their members. "It's critical that directors and senior management be involved in establishing comprehensive policies and procedures to monitor derivative activity," she said.

INVESTOR PROTECTION

With low rates on interest bearing accounts, the last few year have seen a dramatic influx of money into the stock and bon markets, much of it through mutual funds. This infusion o capital has raised concerns about investors being adequately informed and protected. "A number of regulatory agencies including the SEC, have done studies of the industry and found few major problems with the design of the system," emphasized James H. Hugar, a Deloitte & Touche partner who specializes in broker/dealers and investment companies. "There are however, several areas outlined in the SEC's Market 2000' study that require industry response, including increasing market disclosure information, fair market competition and open market access. We help our clients stay on top of these and other issues," Hugar said.

INSURANCE UNDER SIEGE

No segment of the financial services industry is facing a greater set of challenges than the insurance business. While it attempts to redefine its role in the debate over healthcare, the industry is simultaneously dealing with major losses from floods, hurricanes and earthquakes. "California is a particularly challenging environment," said Donald W. Schwegman, partner in the insurance practice. "Many insurers are facing significant changes in their underwriting and investment strategies resulting from economic and regulatory constraints. You need only look at the agenda of our insurance executives symposium held last week to get the idea," he said. The symposium agenda included discussions on capital deployment, derivatives, the regulatory environment and, of course, healthcare reform.

CAPITAL MARKETS
