BackWeb Announces Settlement Agreement with Sybase and Trial Date for Patent Infringement Lawsuit.

(Pink Sheets: BWEBF or BWEBF.PK) announced today that it has reached a settlement in its previously announced patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver.  litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

When a person begins a civil lawsuit, the person enters into a process called litigation.
 with Sybase, Inc. and its subsidiary iAnywhere Solutions iAnywhere Solutions, Inc., a subsidiary of Sybase, Inc., (NYSE: SY) is a software company specializing in mobility (mobile computing), management and security and enterprise caliber database software. , Inc. It also announced that a trial date of April 4, 2011 has been set by the court for the trial concerning BackWeb's lawsuit against the remaining defendants, Microsoft Corporation (company) Microsoft Corporation - The biggest supplier of operating systems and other software for IBM PC compatibles. Software products include MS-DOS, Microsoft Windows, Windows NT, Microsoft Access, LAN Manager, MS Client, SQL Server, Open Data Base Connectivity (ODBC), MS Mail,  and Symantec Corporation.

On March 20, 2009, BackWeb filed a patent infringement lawsuit against Microsoft Corporation, alleging patent infringement and seeking damages, an injunction and a declaration by the Court that Microsoft's software update technologies infringe BackWeb's patents. On April 15, 2009 the lawsuit was amended to include Sybase and iAnywhere. On July 22, 2009 the lawsuit was amended to include Symantec Corporation.

BackWeb and Sybase have negotiated a settlement agreement under which Sybase and iAnywhere acquired a license to the BackWeb patents in question and the companies' claims have been resolved. Terms of the agreement remain confidential.
