Back Yard Burgers Signs Six New Development Agreements for 53 Additional Units.

MEMPHIS, Tenn.--(BUSINESS WIRE)--Dec. 30, 2003

Back Yard Burgers, Inc. (Nasdaq SmallCap:BYBI) today announced the signing of six new agreements for the development of 53 stores over the next seven years. A summary of these new development agreements follows:

-- Thirteen-store agreement with Gresham Hospitality, Inc. The

agreement provides for the development of 11 stores in Cobb,

Cherokee, and Bartow Counties in Georgia and two stores in the

Hilton Head area of South Carolina.

-- Ten-store agreement with Black Cow Enterprises, Ltd. for

development in the Northwest Houston, Conroe, Bryan, and

College Station areas of Texas.

-- Ten-store agreement with BYB, LLC for development in the

Winston/Salem, Greensboro, and High Point areas of North

Carolina.

-- Eight-store agreement with ISOLUC, LLC for development in the

Johnson City, Kingsport, Bristol (Tri-Cities) area of

Tennessee.

-- Six-store agreement with Harrison Restaurant Group, LLC for

development in the Chattanooga, Tennessee, area.

-- Six-store agreement with Bay Burgers, LLC for development in

the Mobile and Daphne areas of Alabama.

The company also recently signed franchise agreements for development of stores in D'Iberville, Mississippi; Elizabethtown, Kentucky; Florence, Kentucky; Charleston, South Carolina; Olathe, Kansas; and Houston, Texas; some of which are being constructed under existing area development agreements.

As of December 30, 2003, the Back Yard Burgers, Inc. restaurant system comprised 133 units, of which 42 are company-operated stores and 91 are franchised stores.
