(Nasdaq SmallCap: BYBI BYBI Backyard Burgers, Inc. ) today announced that its release of earnings for the fourth quarter of 2004 and for the year ended January 1, 2005 will be delayed as a result of the Company's review of accounting practices for leases and leasehold improvements. The Company is reviewing its current method of accounting for leases and leasehold improvements as a result of views expressed by the Office of the Chief Accountant of the Securities and Exchange Commission in a February 7, 2005 letter to the American Institute of Certified Public Accountants With over 330,525 CPA members (in August 2006), the American Institute of Certified Public Accountants (AICPA) is the largest professional organization of Certified Public Accountants (CPAs) in the United States of America.  regarding certain operating lease Operating Lease

The Company will report earnings for the fourth quarter of 2004 and for fiscal year 2004 as soon as practicable after it finalizes its review of the lease accounting issues.
