BUSINESS TO PAVE STREETS IN LUZERNE DEVELOPMENT UNDER AGREEMENT

 HARRISBURG, Pa., Jan. 10 /PRNewswire/ -- A Luzerne County business will spend about $34,000 to pave streets in a Hazle Township housing development under an agreement with Attorney General Ernie Preate Jr.'s Bureau of Consumer Protection.
 If approved by the court, the consent petition will settle a suit filed by the bureau in July 1992 against East Diamond Realty Co., 736 E. Ninth St., Hazleton.
 The suit charged that the company failed to keep its promise to provide a properly constructed and paved road to service properties it sold from 1988 to 1990 in the East Diamond development in Hazle Township.
 As a result, the suit claimed, home owners in the development experienced various problems, including soil erosion and improper drainage.
 Under terms of the agreement, the company will:
 -- Spend an estimated $34,000 to pave four streets in the development.
 -- Pay the state $1,000 in costs of investigation.
 -- Implement an erosion and sediment pollution control plan as approved in December 1992 by the Luzerne County Conservation District.
 -- Take part in negotiations to resolve a conflict over the ownership of one of the streets in the development.
 The agreement was negotiated by Deputy Attorney General J.P. McGowan, attorney-in-charge of the Bureau of Consumer Protection's Scranton office. It was filed today in Luzerne County Common Pleas Court.
