BURBANK SHOOTING VICTIM IDENTIFIED; CHARGES FILED.

The man shot to death outside a Burbank bar Saturday night has been identified as 29-year-old Miguel Hernandez of Sylmar, officials said Monday.

After the argument inside the bar, Triana walked outside and waited for Hernandez, Koch said. Lying in wait is a special circumstance that could add to a murder charge, making it a possible death-penalty case.

Koch said Triana pointed a gun at an unidentified man and threatened him, saying, ``Do you want me to shoot you, too?'' That was the basis for the charge of assault with a deadly weapon, he said.

Triana was arrested after witnesses identified his car, authorities said.

A police helicopter spotted the car at Terra Bella Street and San Fernando Road in Arleta shortly after the shooting, Koch said. Officials recovered a handgun from the car, he said.

It is unclear what Triana and Hernandez were arguing about, as police have received conflicting statements from witnesses, Koch said.

Triana is expected to be arraigned today. He was being held Monday at Burbank City Jail on $1 million bail, Koch said.
