Captains' suit set for fall trial

An Oct. 15 trial date was set for a discrimination lawsuit in which two white Los Angeles fire captains allege that they were unfairly punished for their roles in feeding dog food to black firefighter Tennie Pierce.

Capts. Chris Burton and John Tohill said they were suspended and transferred from a Westchester fire station without due process after Pierce accused them of the fire house prank in October 2004.

Burton and Tohill filed their discrimination lawsuit against the city on Oct. 6, saying that they were unfairly punished, despite taking ``immediate steps to address the dog food incident,'' according to their attorney, Gregory Smith.
