Death sentence is overturned

The California Supreme Court on Thursday overturned a man's death sentence for his role in the 1981 stabbing deaths of a Van Nuys mother and her 8-year-old son as part of a murder-for-hire scheme to collect life insurance.

James Edward Hardy was found guilty in 1983 of conspiracy to commit murder to collect life insurance proceeds in the stabbing deaths of Nancy Morgan and her son, Mitchell. Morgan's husband, Clifford, bought the insurance policies and arranged the murders.

A co-defendant, Mark Anthony Reilly, was also sentenced to death for the murders.

Los Angeles Los Angeles (lôs ăn`jələs, lŏs, ăn`jəlēz'), city (1990 pop. 3,485,398), seat of Los Angeles co., S Calif.; inc. 1850.  County prosecutors argued that Hardy stabbed the mother 45 times and son 21 times at the family's home, while Reilly waited outside or held the victims down.

In his appeal, Hardy contended his defense attorney failed to present evidence to support a claim that another man known to him and Reilly, Calvin Boyd, did the killings.

The justices found that the evidence regarding Boyd -- who testified during the trial under a grant of immunity -- would not have changed the guilty verdict, because Hardy still would have been found to have conspired in the murders.

But the justices held that the evidence could have changed the outcome of the penalty phase of the trial.
