Teen faces trial in juvenile court
SYLMAR - A Rialto teen-ager will be tried in juvenile court on charges stemming from a Lancaster home invasion robbery and a Pearblossom Highway chase in which a California Highway Patrol officer was shot at with an Uzi assault rifle.
A court commissioner ruled Thursday that 18-year-old Mark Anthony Powell should not be tried as an adult as prosecutors had sought.
Powell, who was 17 when the offenses occurred, was charged as an adult under Proposition 21, which allows the District Attorney's Office to prosecute minors as adults for serious offenses. The case went back to juvenile court after an appellate court ruling that some portions of the ballot measure are unconstitutional.
Powell is charged with attempted murder, assault on an officer, robbery and conspiracy to commit robbery.
Delshawn Jermaine Bodney, 24, of Tehachapi was sentenced to 13 years after pleading no contest to robbery. Derrick Owens, 19, of Fontana received a 15-year sentence after entering a no-contest plea to assault on a peace officer. Sonny Martin, 19, of Fontana is on trial, facing charges from the home-invasion robbery.
