BRIEFLY : HACKER MAY EVADE STATE FRAUD CHARGES.


VAN NUYS - A state computer fraud charge lingering against hacker Kevin Mitnick Kevin David Mitnick (born October 6, 1963) is a controversial computer cracker and convicted criminal in the United States.

Mitnick was convicted in the late 1990s of illegally gaining access to computer networks and stealing intellectual property.
 since 1993 will be dismissed if a judge goes along with the prosecution's recommendation, a deputy district attorney said Wednesday.

Mitnick, 36, pleaded guilty in federal court earlier this year to computer and wire fraud, stemming from a cross-country hacking spree that cost several companies about $1.5 million.

On Aug. 9, he is scheduled to be sentenced to 46 months in federal prison. He also must make restitution and is barred from ever using computers.
