Here, assault must be differentiated from battery as they are often confused. Assault is threatening to use force.  and exhibiting a firearm firearm, device consisting essentially of a straight tube to propel shot, shell, or bullets by the explosion of gunpowder. Although the Chinese discovered gunpowder as early as the 9th cent., they did not develop firearms until the mid-14th cent.  in the presence of an officer. A June 9 preliminary hearing is scheduled.

Authorities said that following an argument at last weekend's reception, Morales retrieved a gun from his home and returned. His 51-year-old father, Tony, tried to take the weapon, which fired a round that did not hit anyone, authorities said.

When Chad turned toward a deputy who had just arrived, the officer fired a round that hit Tony, who authorities said was pulled by Chad into the line of fire.

Defense attorney Richard Hanawalt said neither man was holding the gun when the deputy fired a shot. ``No one had it in their hands when the officers arrived,'' he said.
