U.S. District Judge Leonard Sand also refused to dismiss some of the charges in an indictment that contains one count of conspiracy and 22 counts of securities fraud, wire fraud and bank fraud.

Prosecutors have said the four used the company as their ``personal piggy bank.''

In a written ruling, Sand said John Rigas and his son, Michael, have not shown that prejudice might result if all four defendants are tried together.

Rates are mixed on Treasury bills

WASHINGTON - Interest rates on short-term Treasury securities were mixed in Monday's auction.

The Treasury Department sold $16 billion in three-month bills at a discount rate of 0.940 percent, down from 0.945 percent last week. An additional $16 billion was sold in six-month bills at a rate of 1.030 percent, up from 1.025 percent.

The three-month rate was the lowest since July 21, when the bills sold for 0.895 percent. The six-month rate was the highest since June 2 when the rate was 1.095 percent.

In a separate report, the Federal Reserve said Monday that the average yield for one-year constant maturity Treasury bills, the most popular index for making changes in adjustable rate mortgages, rose to 1.26 percent last week from 1.22 percent the previous week.

 Al Franken and the Penguin Group to stop them from using the phrase ``fair and balanced'' in the title of his upcoming book.

Filed Monday in Manhattan, the trademark infringement lawsuit seeks a court order forcing Penguin to rename the book, ``Lies and the Lying Liars Who Tell Them: A Fair and Balanced "Fair and Balanced" is a trademarked slogan used by American news broadcaster Fox News Channel. The slogan was originally used in conjunction with the phrase "Real Journalism.  Look at the Right.'' It also asks for unspecified damages.

Fox News registered ``Fair & Balanced'' as a trademark in 1995, the suit says.

Franken's ``intent is clear - to exploit Fox News' trademark, confuse the public as to the origins of the book and, accordingly, boost sales of the book,'' the suit said.

Calls to Penguin and Franken's publicist were not immediately returned. The book is due out next month.

MetLife's profits adjusted down

NEW YORK - MetLife Inc. lowered its previously reported second-quarter earnings by $31 million on Monday because of improperly deferred expenses at its New England Financial affiliate, and said the president of the division had left the company.

The New York-based life insurer said adjusted net income comes to $580 million, or 79 cents a share, rather than $611 million, or 84 cents a share, as reported last week. The company earned $387 million, or 53 cents per share Cents per share
