BOLEN DEFENDS AMERICAN PATENT RIGHTS AGAINST LIPTON IN CASE INVOLVING WISH-BONE SALAD DRESSING

CLOSTER, N.J., Feb. 5 /PRNewswire/ -- Bolen Packaging Corporation has filed suit in the United States District Court for the District of New Jersey, accusing Conopco, Inc., who does business as Thomas J. Lipton Company, and others, of patent infringement and malicious abuse of process, Judge H. Lee Sarokin presiding.
Other defendants are accused of tortuously interfering with Bolen's prospective economic advantage.
The suit, in which Bolen seeks both compensatory and punitive damages, deals with Bolen's patents which are asserted to cover the dispensing closures used by Lipton on its Wish-Bone and Healthy Sensation Salad Dressings.
Bolen Packaging has broad worldwide patent protection with continuation applications and coverage in 28 countries, including the United States, Europe and Asia. The Bolen Patents combine unprecedented style, function and economy advantages in competing with Foreign Closure Technologies dominant in the American marketplace.
Also challenged in the lawsuit are the actions of Lipton's employees in attempting to claim inventorship of Bolen's patented inventions in a Patent Office proceeding which Lipton later voluntarily abandoned.
Citing a Nov. 17, 1992 Associated Press Report of the White House Office on Science and Technology that this type of activity by foreign competitors is costing the United States economy $100 billion annually, Robert Bolen, CEO echoes former CIA Director William Webster's warning that, "the United States must learn what its competitors are doing if there is be a level playing field."
Defendant Conopco, Inc. (Lipton) is a subsidiary of London- Rotterdam, based in Unilever N.V.
