BOARD WANTS STATE COURT TO REVIEW DEPUTY PENSIONS.

The Board of Supervisors is the body governing counties in the U.S.
 decided to ask the state Supreme Court to clarify its decision last week on a lawsuit regarding sheriff's deputies' pension payments.

``What we're going to be doing is going forward with a rehearing rehearing n. conducting a hearing again based on the motion of one of the parties to a lawsuit, petition or criminal prosecution, usually by the court or agency which originally heard the matter.  at the appeals level and primarily on clarification of what that all means,'' said Supervisor Frank Schillo.

The state Supreme Court decided last week that certain ``cash bonuses'' such as uniform stipends and extra pay for bilingual abilities, should be added to sheriff's deputies' pension payments.

Schillo said the petition for reconsideration might ask the court to clarify whether benefits such as car allowances and accrued ac·crue

 Supervisor Frank O. Sieh said the petition likely will be broad in scope.

``What form that petition for reconsideration is going to take is not final yet,'' Schillo said. ``We're going to ask the court to clarify a couple of points in the decision, but whether or not we're going to ask them about individual benefits is not determined.''

In addition, Sieh said the county probably will not ask the court to reverse its decision altogether.

``The opinion was a unanimous opinion,'' he said. ``And our feeling is we will probably be addressing portions rather than the whole opinion.''

The board convened for a special session Wednesday because the petition for reconsideration must be filed by Aug. 29.
