BOARD TRIES TO BLOCK PROSECUTORS' APPEAL.

Senior prosecutors Adam Pearlman and Mark Pachowicz contend they were transferred from the criminal division to the child support services support services Psychology Non-health care-related ancillary services–eg, transportation, financial aid, support groups, homemaker services, respite services, and other services  division because they backed Ron Bamieh's failed campaign for district attorney. They were reassigned three weeks after the March 5 election.

Voting unanimously, the Board of Supervisors decided in a closed meeting to allow lawyers for the county to file a writ in Superior Court to block the appeal. County Counsel Frank Sieh argued that the job transfers were not the jurisdiction of the Civil Service Commission because they did not involve pay cuts or disciplinary action. Sieh said the writ would be filed this month.

Pearlman, a 12-year veteran of the criminal division, said while the decision doesn't surprise him, he's disappointed he can't have his day before the commission.

Bradbury, who has maintained the transfer is unrelated to the election, referred all calls to the county counsel.

Deputy District Attorney Greg Totten, who will take over the position of district attorney Nov. 1, also referred calls to the county counsel.

Leroy Smith, a supervisor for County Counsel's Office, said the decision to file the writ concerned a much larger issue.

``We're concerned about opening the floodgates to action any time an assignment is changed,'' he said. Arguing that the prosecutors were alleging a ``free speech violation,'' he suggested they file suit in court.
