requires developers to either set aside property or contribute money for new schools. Builders can choose to pay up front then pass the costs along to buyers of new homes, or arrange for school districts to collect the money as a special tax.

``The homeowners are going to pay for it anyway,'' Cutting said.

Meanwhile, Saugus is expected to close negotiations in the coming weeks with Montalvo Properties, which has plans to build more than 600 homes in Tesoro Del Valle.

``We're currently working with Montalvo to compete the transaction so that the entire development is secured by a revised mitigation MITIGATION. To make less rigorous or penal.

When the Tesoro development began taking shape in 1997, the builders had agreed to pay the school district $6.8 million. But Saugus has managed to negotiate a better deal as the project changed hands over the past two years.

``Both (SunCal and Montalvo) have been very cooperative,'' Cutting said. ``We can't build a school for $6.8 million. Exclusive of the land, we're estimating the cost (for a new school) would be about $13.5 million.''

With more than 10,000 students between 14 campuses, the Saugus school district expects enrollment to increase by 700 when the Tesoro development is built out.

``Enrollment is at 91 percent of our capacity,'' Cutting said. ``We need to build another school within 18 months. (Tesoro Del Valle) is where we anticipate the next school we will construct would be at.''
