BIRTCHER MEDICAL SYSTEMS CONFIRMS DISCUSSIONS WITH PFIZER
IRVINE, Calif., June 26 /PRNewswire/ -- Birtcher Medical Systems, Inc. (NASDAQ: BIRT) today issued the following statement:
In response to an increase in its stock price on relatively heavy volume and rumors in the marketplace, Birtcher Medical Systems confirmed today that it is engaged in discussions to license its patented argon beam coagulation technology to Valleylab, Inc., a subsidiary of Pfizer, Inc. (NYSE: PFE), as part of a resolution of a patent lawsuit filed in March.
William E. Maya, president and chief executive officer of Birtcher, stated "We have always said that we were willing to discuss a possible license of our technology for a reasonable royalty. We are willing to discuss a license to Valleylab, Inc. as part of a mutually beneficial resolution of this matter." Maya added, "I should emphasize that our discussions are still in the early stages. We have not yet reached a final agreement, and we may not be able to do so. To the extent we are unable to resolve this matter, we will continue to defend this lawsuit vigorously."
A hearing on Birtcher's motion to dismiss the lawsuit is scheduled for hearing on August 21 in the United States District Court for Colorado.
