BELLEVILLE & AEROVOX PETITION SUPREME COURT TO REVIEW FIRST CIRCUIT RULING

BELLEVILLE & AEROVOX PETITION SUPREME COURT
 TO REVIEW FIRST CIRCUIT RULING
NORTH DARTMOUTH, Mass., Dec. 6 /PRNewswire/ -- Aerovox Incorporated (NASDAQ: ARVX) has announced that Belleville Industries, Inc. has petitioned the Supreme Court of the United States to review the July opinion of the First Circuit Court of Appeals that found Lumbermens Mutual Casualty Co. not obligated to provide insurance coverage to Belleville Industries for damages resulting from the alleged disposal of PCBs in the Acushnet River and the New Bedford Harbor. Belleville Industries is a prior owner of the Aerovox site in New Bedford, Mass.
The appellate court's July opinion reversed an earlier ruling by the U.S. District Court that obligated Lumbermens to provide insurance coverage to Belleville. Aerovox had appealed the $16,000 amount of indemnification awarded in that ruling and sought a decision to restore the $2 million indemnity provided by the insurer at the time the environmental settlement agreement was reached in February 1990.
