On August 8, 1996, the United States Court of Appeals The United States courts of appeals (or circuit courts) are the intermediate appellate courts of the United States federal court system. A court of appeals decides appeals from the district courts within its federal judicial circuit, and in some instances from other  for the Eighth Circuit released its opinion in the case of Morrison v. Back Yard Burgers, Inc. The Court of Appeals upheld the U.S. District Court's decision that Back Yard Burgers, Inc. (the "Company") was entitled to summary judgment in its favor as to all claims asserted against the Company by former franchisees, Jerry and Helen Morrison. Following the release of the opinion in the Morrison case, legal counsel for the remaining franchisee litigants, Pezzecca Enterprises, Inc., Chris Powell and Scott Townsend, announced the franchisees' intentions to dismiss their appeals pending before the Sixth Circuit Court of Appeals. The U.S. District Court for the Western District of Tennessee had previously granted the Company summary judgment as to all claims asserted against the Company in these cases.

Commenting on the Court's decision, Lattimore Michael, Chairman and Chief Executive Officer of Back Yard Burgers, said, "We are glad to have these lawsuits settled. We have maintained from the beginning that the suits were without merit and are happy that we have been totally vindicated. We remain committed to improving and expanding the Back Yard Burgers system."

Back Yard Burgers operates and franchises quick-service restaurants in Memphis, Little Rock, Nashville and other markets across 15 states. The Company features gourmet hamburgers and chicken sandwiches, name-brand condiments and beverages as well as hand-dipped milkshakes, fresh-squeezed lemonade and fresh-baked cobblers.
