BABY P BEAST FREE IN 2 YEARS; Court's mercy for callous scum who let torture tot die.

BABY P monster Jason Owen is set to walk free in less than two years after appeal judges cut his sentence yesterday.

Owen, 37, was given an unlimited prison term for his role in the horrific death of 17-month-old Peter Connelly.

But the Court of Appeal ruled that the sentence was "a step too far" - because there was no evidence Owen would pose a serious threat to others in future.

The judges replaced the indefinite term A prison sentence for a specifically designated length of time up to a certain prescribed maximum, such as one to ten years or twenty-five years to life.  with a six-year sentence. The ruling means Owen will serve a minimum of three years. And because he spent 289 days in jail on remand To send back.

A higher court may remand a case to a lower court so that the lower court will take a certain action ordered by the higher court. A prisoner who is remanded into custody is sent back to prison subsequent to a Preliminary Hearing before a tribunal or magistrate
 before he was sentenced, he could be back on the streets in August 2011.

Owen was a lodger An occupant of a portion of a dwelling, such as a hotel or boardinghouse, who has mere use of the premises without actual or exclusive possession thereof. Anyone who lives or stays in part of a building that is operated by another and who does not have control over the rooms therein.  at the London flat where little Peter suffered months of savage abuse and neglect under the noses of social workers and doctors.

He was jailed along with Peter's mum, Tracey Connelly, 28, and Connelly's boyfriend Steven Barker, 33, who is Owen's brother.

Fractured

All three were given indefinite INDEFINITE. That which is undefined; uncertain.

INDEFINITE, NUMBER. A number which may be increased or diminished at pleasure.

Barker is also serving life for raping a two-year-old girl.

Peter had more than 50 injuries, including a broken back and eight fractured ribs, when he was found dead in his bloodied cot in August 2007.

 the nation and led to a massive shake-up of Haringey Council social work department. The director, Sharon Shoesmith, was fired.

Owen's lawyers claim he was not involved in the torture of Peter, although he was living in the flat.

And his QC, Tim Roberts, told the appeal court in London that his client's indefinite sentence was "wrong in principle" because there was no evidence he posed a significant risk to the public.

Senior judge Lord Justice Hughes agreed. He said of Owen: "His offence is deeply unpleasant because a completely innocent child who he could have protected was not protected by him. A complete lack of care was ingrained in·grained

The judge added: "He displays a willingness to deceive TO DECEIVE. To induce another either by words or actions, to take that for true which is not so. Wolff, Inst. Nat. Sec. 356. , which is unattractive.

"But to translate that into a significant risk that he will commit offences involving death or serious injury is simply a step too far."

Owen was not in court for the ruling. He, Connelly and Barker are all likely to be given new identities at taxpayers' expense to protect them after they get out of jail.
