Axis Homocysteine Patent is Greatly Narrowed by European Patent Office Opposition Proceedings, Announces A/C Diagnostics.

Homocysteine is a naturally occurring amino acid found in blood plasma. High levels of homocysteine in the blood are believed to increase the chance of heart disease, stroke, Alzheimer's disease, and osteoporosis.
 European Patent Number EP0726322, which originally had very broad claims covering essentially any type of homocysteine assay, was greatly narrowed by the European Patent Office Opposition Division after hearings on October 5. The patent now will cover only homocysteine assays that use any of the following three enzymes: cystathionine [eth]-synthetase, betaine-homocysteine-methyltransferase, and methyl-tetrahydrofolic acid methyltransferase (methionine methionine (mĕthī`ənēn), organic compound, one of the 20 amino acids commonly found in animal proteins. The decision by the European Patent Office Opposition Division now opens the European market to many different types of homocysteine assays which should satisfy many needs in the market.

The patent was opposed by AntiCancer Inc., parent of A/C Diagnostics, and the Diazyme Corporation.

A/C Diagnostics offers the A/C Enzymatic Homocysteine Assay, which is not covered not covered Health care adjective Referring to a procedure, test or other health service to which a policy holder or insurance beneficiary is not entitled under the terms of the policy or payment system–eg, Medicare.
