JDPI made false statements about receiving a judgment against Aubryn for the use of the "Jack Daniel's" brand name, when in fact Aubryn had agreed not to. In addition, Aubryn issued a news release clarifying what their intentions were, on June 15, 2001.

JDPI asked Jack E. Daniels, president of Gorman Properties, not to use his birth name on any documentation, press, etc. They also stated that Aubryn had infringed on their trademark when Aubryn never stated that they had a contract with JDPI or intended on using the brand name "Jack Daniel's" on its bottled water.

Aubryn is seeking an injunction, in addition to the libel and punitive damages, forbidding JDPI from publishing any additional false and misleading information to the public.

"In response to the frivolous lawsuit filed by JDPI alleging that Aubryn misrepresented themselves in the water rights properties with Gorman Properties and J. Daniels, we have filed a counter suit for a sum of over $18 million," stated R.
