Under the terms of the settlement, which is subject to City Council ratification, the City will pay to Atlantic Gulf $18.75 million. The settlement was reached prior to the start of a jury trial scheduled to begin on March 4, 1996 and is expected to be ratified by the City Council on Wednesday, March 6, 1996. The settlement amount is in addition to the $45 million paid to GDU in 1990 by St. Lucie County, which originally took the system through eminent domain eminent domain, the right of a government to force the owner of private property sell it if it is needed for a public use.
