ArmorWorks Files Complaint in U.S. District Court Against Ceramic Protection Corporation, Ceramic Protection Corporation of America, and Certain Individuals.


TEMPE, Ariz. -- ArmorWorks, a leading provider of advanced armor products, today announced the filing of a Complaint on the 11th of September 2006 in the United States District Court for the District of Arizona against Ceramic Protection Corporation, Ceramic Protection Corporation of America, and certain individuals.

The Complaint alleges and seeks recovery of damages for breach of contract, breach of the implied covenant of good faith and fair dealing implied covenant of good faith and fair dealing n. a general assumption of the law of contracts, that people will act in good faith and deal fairly without breaking their word, using shifty means to avoid obligations, or denying what the other party obviously understood., breach of warranty breach of warranty n. determination that a statement as to title of property, including real property or any goods, is proved to be untrue, whether intended as a falsehood or not. It can also apply to an assurance of quality of a product or item sold. The part making the warranty is liable to the party to whom the guarantee was made., fraud, tortious tortious adj. referring to an act which is a tort (civil wrong). (See: tort) interference with contract, tortious interference with business expectancy, misappropriation of trade secrets and violation of the Lanham Act and unfair competition. ArmorWorks alleges damages of not less than $60,000,000 dollars. ArmorWorks also alleges that it is entitled to an award of punitive damages in an amount not less than five times the actual damages. ArmorWorks has demanded a jury trial.

The Complaint contends that Ceramic Protection Corporation is a Canadian corporation with its head office in Calgary, Alberta, Canada. Its stock trades on the Toronto Stock Exchange (TSX) under the stock symbol CEP.

The Complaint asserts that Ceramic Protection Corporation of America, formerly known as ALANX Wear Solutions, Inc., is a Delaware Corporation.
