Applied Materials Finds Novellus' Patent Suit Meritless.


SAN JOSE, Calif.--(BUSINESS WIRE)--July 1, 1997--Applied Materials Inc. commented today that a patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver.  suit filed by Novellus Systems Inc. on June 23, 1997 was without merit and in the nature of a typical counterclaim A claim by a defendant opposing the claim of the plaintiff and seeking some relief from the plaintiff for the defendant.

Varian recently sold the assets of this PVD business to Novellus, along with related intellectual property rights, including Varian's PVD patents. Novellus' lawsuit, which asserts the Varian PVD patents, was announced the same day as the announcement of the completion of the acquisition of Varian's Thin Film Systems business unit.

Tom St. Dennis, Applied Materials Vice President stated, "Applied's dispute is with Varian's infringement of Applied's patented rights, which had been raised with Varian some time ago, and with Varian's introduction of the new Inova platform, which expands this infringement. Because Varian refused our invitation to meet and discuss these issues, Applied was required to file suit. Applied will vigorously defend against this suit by Novellus, and will continue to pursue Applied's suit with respect to the MB2, M2I and Inova PVD systems."
