On January 29, 2003, the Federal Circuit Court of Appeals overturned the jury verdict against Rambus in the Infineon case, finding that Rambus's conduct did not constitute actual fraud. Based on this ruling, Lead Plaintiffs moved to dismiss the Class Action with prejudice. The Court granted Lead Plaintiffs' motion and dismissed the Class Action. The dismissal of the Class Action does not prevent any individual investor covered by this Class Action from bringing his own lawsuit against Rambus, so long as the lawsuit is brought within the time provided by the statute of limitations A type of federal or state law that restricts the time within which legal proceedings may be brought.
