The '008 patent claims purified and isolated DNA sequences encoding erythropoietin and host cells transformed or transfected with a DNA sequence. The '008 patent was held valid and infringed by GI in the prior litigation. The GI '195 patent refers to patent 4,677,195, issued on June 30, 1987, claiming homogeneous EPO as characterized by certain attributes. GI's '195 patent was held invalid for lack of enablement by the Federal Circuit in March 1991. On June 21, 1994, the '837 patent was issued to GI, again claiming homogeneous EPO characterized by certain attributes. On the same day GI received this patent, it brought suit in U.S. District Court for the District of Delaware against Ortho Biotech Corp., Amgen's distributor, charging that Ortho infringed the '837 patent.
