Amersham and PerkinElmer start legal battle.


Boston, MA 10/23/03 and 10/30/03--Dow Jones Newswire reports that Amersham has filed suit against PerkinElmer and PerkinElmer has responded with a countersuit coun·ter·sue

To bring proceedings against (a plaintiff) in direct opposition to a suit brought against onself.
. Amersham alleges that PerkinElrner ViewLux and Image FlashPlate patents infringe two of its patents for using luminescence luminescence, general term applied to all forms of cool light, i.e., light emitted by sources other than a hot, incandescent body, such as a black body radiator.  and fluorescence fluorescence (flrĕs`əns), luminescence in which light of a visible color is emitted from a substance under stimulation or excitation by light or other forms of electromagnetic  screening technology. PerkinElmer alleges that Amersham infringes its patent for imaging systems "employing CCD-based optical imaging technology, including the LEADseeker Multimodality Imaging System and IN Cell Analysis System." Both companies seek damages and to stop sales of the infringing product.

Neither company has issued a formal announcement regarding the matter. PerkinElmer spokesperson Dan Sutherby told Dow Jones Dow Jones

 that the Amersham suit was without merit. The areas in dispute relate to the screening market that is growing in significance and clearly is worth defending.
