In that suit, Xilinx moved in late June for summary judgment that, as a matter of law, Xilinx's XC3000 and XC4000 product families do not infringe three Altera patents. A hearing on the motion was held on October 14, 1994. On December 6, Judge Robert P. Aguilar denied Xilinx's motion.

Altera's suit seeks an injunction to prevent further sales of Xilinx's XC3000 and XC4000 families. The Judge has not yet scheduled a trial date of Altera's patent infringement claims.

"This ruling puts a stop to Xilinx's efforts to confuse the issues in this case, and will let us move forward to trial on the merits on the merits adj. referring to a judgment, decision or ruling of a court based upon the facts presented in evidence and the law applied to that evidence.
