, that the company expected to earn approximately $3.8 million pre-tax in 1996, or $.40 per share after taxes.

Wolf said the earnings were calculated on the current historically high commodity cheese price of $1.49 per pound. "If the price of cheese had remained at its historic long term average price of $1.28, the company could have earned as much as $7 million pre-tax or $.74 a share after tax in 1996."

Wolf added that he believed the price of cheese would eventually return to its historic average of approximately $1.28 per pound. "There is no question that farmers can make a profit with $1.28 cheese," he told shareholders. "I believe the $1.49 cost, which has hurt our margins, is an aberration which will be corrected in the long run."

Wolf also told shareholders that the company legal counsel had recommended, and the board of directors determined, to pursue an appeal to the U.S. Court of Appeals for the Federal Circuit in Washington, regarding its patent infringement patent infringement n. the manufacture and/or use of an invention or improvement for which someone else owns a patent issued by the government, without obtaining permission of the owner of the patent by contract, license or waiver.  suit against Kraft.
