Alpha Media Group Initiates Legal Action against EMI Resorts (S.V.G.) Inc.

 -- Alpha Media Group Inc., publisher of Maxim, has initiated a lawsuit in the U.S. District Court for the Southern District of New York against EMI (ElectroMagnetic Interference) An electrical disturbance in a system due to natural phenomena, low-frequency waves from electromechanical devices or high-frequency waves (RFI) from chips and other electronic devices. Allowable limits are governed by the FCC.  Resorts (S.V.G.) Inc., the developer and operator of the Sun Village Resorts in the Dominican Republic. In the Complaint, Alpha Media contends that EMI Resorts has breached the terms of the parties' licensing agreement that entitled EMI Resorts to use the Maxim brand name in connection with its resorts. The Complaint seeks an injunction against EMI Resorts to, among other things, stop using the Maxim mark.

Alpha Media Group Inc. has also filed with the court a request for a preliminary injunction A temporary order made by a court at the request of one party that prevents the other party from pursuing a particular course of conduct until the conclusion of a trial on the merits.

A preliminary injunction is regarded as extraordinary relief.

Enjoin connotes a degree of urgency, as when a court enjoins one party in a lawsuit by ordering the person to do, or refrain from doing, something to prevent permanent loss to the other party or parties.
 EMI Resorts from any further use of the Maxim mark pending the lawsuit.

The Complaint also alleges that Alpha Media Group Inc. has been seeking to terminate the licensing agreement with EMI Resorts since June 19, 2008, and that continued use of the Maxim name by EMI Resorts is without consent.
