) said today that it is aware of and finds no validity in a lawsuit filed against it by a California couple. A physician was also named in the lawsuit.

"We have reviewed the complaint and reject the allegations and this lawsuit as frivolous," said Douglas S. Ingram, Corporate Vice President and General Counsel. "Allergan stands behind the well-established safety record of BOTOX(R). We intend to aggressively defend our product in Court and do not intend to resolve this matter short of complete vindication."

"BOTOX(R) has an extraordinary 20-year safety history and has improved the lives of over a million people around the world, many suffering from debilitating de·bil·i·tat·ing

(uncontrollable blinking). The allegations in the claim are completely inconsistent with this extensive safety profile," continued Ingram. "BOTOX(R) has been commercially available in the U.S. since 1989. It is unfortunate, but not entirely unexpected, that someone might eventually decide to use a legal claim as a tactic for financial gain. We will, however, vigorously defend this lawsuit and the long-standing reputation of this exceptional product."

BOTOX(R) and BOTOX(R) Cosmetic are currently approved for marketing in the United States. BOTOX(R) therapy carries the unique distinction of being the only product of its kind with over 20 years experience in development and successful clinical practice in people worldwide. It is currently approved in more than 70 countries for a broad range of neurological and aesthetic conditions including cervical dystonia, juvenile cerebral palsy, strabismus (crossed eyes), blepharospasm (uncontrollable blinking) and glabellar lines. In the United States, BOTOX(R) has been approved since 1989 and is in clinical trials for the treatment of hyperhidrosis (excessive sweating), post-stroke spasticity spasticity /spas·tic·i·ty/ (spas-tis´i-te) the state of being spastic; see spastic (2).
