Rothman commented further: "The dismissal of all lawsuits against my client FFC, by APTX, confirms the fact that the spurious allegations made by APTX and the former director of APTX, Mr. Samuel S. Guzik, stating that FFC breached its obligations to APTX and violated Securities Laws were totally without merit, and were probably a groundless reaction to the lawsuits which were filed by my law firm earlier by FFC against both Samuel S. Guzik, Kathy Van Ness and APTX."

Rothman further stated: "Although APTX has dismissed their lawsuit against FFC, we are continuing all our lawsuits against both Samuel S. Guzik and Kathy Van Ness in an effort to recover some of the substantial losses our client FFC has incurred in connection with their investment into APTX partially as a result of the misrepresentations made by both Kathy Van Ness and Samuel S. Guzik.

"We have furthermore reported Samuel S. Guzik, who actually represented FFC as a client before becoming a director of APTX, to the State Bar of California for representing interests adverse to a former client."
