) today announced a final resolution of a long-standing patent dispute with Cable & Wireless Internet Services, Inc. In December 2001, a jury found that Digital Island's Footprint content delivery service infringed claims 1, 3, 5, 9, 17, 18 and 22 of U.S. Patent No. 6,108,703, issued in the name of Akamai founders Tom Leighton and the late Danny Lewin. Despite its finding that CWIS infringed claims 17, 18 and 22 of the '703 patent, the jury also found that those particular claims were invalid.

 the resolution announced today, Akamai and CWIS have settled their remaining dispute -namely, the amount of damages to be paid to Akamai as a result of the jury's finding that CWIS was infringing Akamai's intellectual property rights. The settlement includes a cash payment to Akamai for these damages.

In a related development announced today by Akamai, the Federal District Court in Boston has granted a motion by Akamai to overturn the original jury verdict with respect to '703 patent claims 17, 18 and 22. This latest action means those claims, which cover important aspects of Akamai's core Internet content delivery technology, are not invalid.
