) has two electric cases pending before the Missouri Public Service Commission.

In Case No. ER-97-81, the Commission has approved a $10,589,964 annual rate increase, effective July 28. In addition, the Commission has under consideration in that docket an application for rehearing rehearing n. conducting a hearing again based on the motion of one of the parties to a lawsuit, petition or criminal prosecution, usually by the court or agency which originally heard the matter.  to address an additional $3,352,013 in rate relief associated with Empire's new generating unit, State Line II. All parties involved, the Commission Staff, the Office of the Public Counsel, and the industrial intervenors, have consented to an additional $3 million rate increase to reflect the in-service status of this plant and an agreement to this effect has been submitted to the Commission for approval. The Commission is expected to act on this agreement in the near future. Empire believes that the agreement represents a reasonable compromise and resolution of the rehearing request.

In a related action, Empire filed a new rate request docketed as Case No. ER-98-54, to recover the same $3,352,013 addressed by the rehearing application. The Commission suspended sus·pend

The Empire District Electric Co. is an investor-owned utility providing electric service to approximately 101,294 residential, 18,516 commercial and 267 industrial customers in southwest Missouri. The company also provides electric service to customers in southeast Kansas Southeast Kansas is a region of the U.S. state of Kansas. It can be roughly defined by Woodson County in the northwest, Bourbon County in the northeast, Cherokee County in the southeast, and Montgomery County in the southwest. , northwest Arkansas and northeast Oklahoma.
