Afternic.com Accepts ICANN Settlement Proposal, Extraactive Accredited.

On July 3, 2000, three days prior to scheduled depositions of key ICANN (Internet Corporation for Assigned Names and Numbers, www.icann.org) A non-profit, international association founded in 1998 and incorporated in the U.S. It is the successor to IANA (Internet Assigned Numbers Authority), which manages Internet addresses, domain names and the huge number  personnel, ICANN's legal counsel contacted Afternic.com's lawyers to discuss the possibility of a last minute settlement of the suit brought by Afternic.com and eXtraActive. Unlike previous settlement discussions and all discussions prior to the suit, ICANN agreed to put into writing that an ICANN accredited accredited

recognition by an appropriate authority that the performance of a particular institution has satisfied a prestated set of criteria.

ICANN proposed, drafted, and signed a side letter to the April 7, 2000 assurances, which essentially overrides assurances 4 and 5. Assurances 4 and 5 forbade for·bade

 eXtraActive from partnering or linking with Afternic.com, removing any reason for eXtraActive to pursue accreditation in the first place. It was these 2 assurances, and ICANN's refusal to remove them, that ultimately compelled Afternic.com and eXtraActive to litigate against ICANN as a last resort.

Given that ICANN has agreed to allow Afternic.com and eXtraActive to compete as co-branded, cross-linked partners in the domain name industry like other accredited registrars, Afternic.com is willing to dismiss the suit without prejudice Without any loss or waiver of rights or privileges.

When a lawsuit is dismissed, the court may enter a judgment against the plaintiff with or without prejudice. When a lawsuit is dismissed without prejudice
 to its reinstitution after November 15, 2000.

Afternic.com has only pursued the right to compete on a level playing field See net neutrality. . We feel that our settlement with ICANN achieves this end. In the eight months that have passed since we initially applied for accreditation, we have seen other registrars enter the domain aftermarket. However, we have retained a leadership position in the aftermarket, and now with an ICANN accredited sister company, we will continue to pioneer the domain name industry.

We look forward to participation, alongside ICANN representatives, in ICANN's maturation process to become a consensus driven organization responsible for the technical management of the Internet.
