Last year, Aerovox reached out-of-court settlements with both Kuk Kwang Electric Company and Dae Yeong Company and their U.S. affiliates. The Company recently filed a motion to dismiss the suit against Samwha. On February 6, 2001, Samwha issued a press release in which it claimed that Aerovox dismissed the case because it had been charged with fraud. "This is patently false," stated Aerovox President and Chief Executive Officer, Robert D. Elliott. "No such charge was ever filed by Samwha or anyone else in this case. The patent was legally obtained through the normal procedures of the U.S. Patent Office. Aerovox had a strong case against all of the defendants. In fact, the District Judge denied Samwha's preliminary effort to show that it does not infringe the patent and that the patent is invalid. Aerovox's dismissal was an economic decision based on the exorbitant cost of litigation and in no way on the merits on the merits adj. referring to a judgment, decision or ruling of a court based upon the facts presented in evidence and the law applied to that evidence.
