The court further ordered Axiom, Inc. to withdraw its application to register "Axiom" as a trademark or service mark, and to destroy all advertising, packaging, promotional materials and other items bearing the "Axiom" name. "Protection of our brands and the Acxiom name is of the utmost concern to us, and this suit makes a statement that we will take action to protect them." In holding that Axiom, Inc. had infringed upon Acxiom's trademark, the court determined that Axiom, Inc.'s use of the mark "Axiom" to identify its products or services was likely to create confusion concerning the origin of the products or services. Significantly, the court also held that there was a likelihood that investors would be confused by the similarity of the two names. Acxiom presented evidence at trial demonstrating several incidents of investor confusion which occurred when news reports of Axiom, Inc.'s declining stock price had been mistakenly attributed to Acxiom.
