AUTO TRACK PLANNED AT CALIFORNIA CITY.

CALIFORNIA CITY - California City is moving forward with eminent domain eminent domain, the right of a government to force the owner of private property sell it if it is needed for a public use. The right is based on the doctrine that a sovereign state has dominion over all lands and buildings within its borders, which has its origins in  proceedings to acquire about 100 parcels needed for a Hyundai/Kia auto test track, but some property owners are saying they will fight the move.

Approximately 85 percent of the 4,300 acres needed for the test track has been acquired. The city is in the process of acquiring approximately 105 other parcels separate from the eminent domain action.

In eminent domain proceedings, the price for property acquired by a government agency is set by a judge.

Some property owners are objecting to the eminent domain proceedings, stating the proceedings are for the benefit of a corporation and not for the public good. The property owners are also contesting a finding that the area is urbanized and blighted blight

``They don't think it's an appropriate use of eminent domain,'' said attorney June Ailen, who represents four property owners. ``The area is not urbanized and blighted.''

There is a provision in redevelopment law that allows a redevelopment agency to characterize open desert as urbanized and blighted if there are multiple property owners and the parcels are of irregular shape and the size is not suited for development.

Ailen said in this case, the parcels are of square or regular shapes, not irregular and that few of the parcels are smaller than 2.5 acres, making them suitable for development.

Ailen said she could not comment on whether her clients will file a lawsuit over the issue.

The Hyundai/Kia test track is proposed north of Highway 58 about eight miles east of Mojave.
