Judge Pro's ruling against the Lemelson Medical, Educational & Research Foundation, Limited Partnership follows a 27-day bench trial under way from November 2002 to January 2003 in Las Vegas Las Vegas (läs vā`gəs), city (1990 pop. 258,295), seat of Clark co., S Nev.; inc. 1911. : TKX TKX The Knowledge eXchange (trademark of Kodak) .TO); and Zebra Technologies Corporation (NASDAQ: ZBRA) -- jointly filed suit in federal court in Nevada against the Lemelson Partnership seeking a declaration that certain patents asserted by the Lemelson Partnership against end users of bar code equipment were invalid, unenforceable and not infringed. In 2000, the case was consolidated with a similar case filed by Cognex Corp., a maker of machine vision systems.

"We at Symbol Technologies are, of course, very happy about Judge Pro's decision as we believed all along the Lemelson patents were invalid, unenforceable and not infringed by our customers," said William Nuti, Symbol president and chief executive officer.

"Over the years, the Lemelson Partnership has put significant pressure on Symbol and the entire Auto ID industry, as well as customers of Auto ID companies. Symbol and the other leaders of the Auto ID industry filed this lawsuit to protect our customers and the industry. In our view, this ruling should lead to the end of the Lemelson Partnership's campaign to extract licensing revenue from users of bar code technology. While the Lemelson Partnership is likely to pursue an appeal, we believe that Judge Pro's ruling would be upheld by the U.S. Court of Appeals for the Federal Circuit," Nuti added.

In his decision, Judge Pro wrote, "Symbol and Cognex products do not work like anything disclosed and claimed by Lemelson, nor do those products embody each and every limitation of any claim asserted by Lemelson.... In sum, Lemelson's patented system could not be used to read a bar code, nor does the Lemelson common specification reveal any teaching or suggestion of catching information or identifying an article by the decoding of encoded information."

The decision also states, "... Lemelson's delay in securing the asserted patent claims is unexplained and unreasonable. Plaintiff's ample evidence of intervening rights vividly illustrates the type of public and private injury which can results from an unreasonable delay in prosecuting patent claims. As a consequence, Lemelson's asserted claims must be deemed unenforceable...."
