Attorney Brian Reed was seeking the hearing on behalf of a rejected cheerleader's mother, who accused the coach of manipulating the selection process against her daughter.

``We believe the court will indeed grant the (order),'' Reed said after a hearing in Palmdale Superior Court.

 told Reed on Thursday that he doubted it was possible for him to show just cause for the court order.

``We want this ridiculous case to go down the toilet where it belongs,'' Parris said.

, mother of the rejected cheerleader, who claimed the coach manipulated the selection process against her daughter because she had bested the daughter of a friend in the Miss Quartz Hill contest more than a year earlier.

Smith and her daughter filed a formal complaint against cheerleading coach Tammy Stewart in June but the high school district board decided against any discipline.

The anti-SLAPP statute is designed to protect the right to free speech, according to legal experts. If somebody files a suit that is an attempt to get back at someone who exercised their right to free speech, the statute provides the ability for the defendant to charge suppression of free speech.

The petition claims that Stewart told some of the judges at the tryouts whom she wanted on the team, how to vote and whom to give low scores.

According to Parris, allegations that Stewart did not like Smith's daughter are false. In addition, Parris said the girl would not have made the team even without the coach's score.

Parris said he decided to take on the case to make a statement against petty lawsuits.

``The reason we're involved is these cases give lawyers bad names,'' Parris said.
