 SUNNYVALE, Calif., May 4 /PRNewswire/ -- Atari Corp. (AMEX: ATC)


today reported that its suit against Nintendo Co. of America had resulted in a mistrial. While a Federal District Court Jury found that Nintendo had monopoly power in the United States home video game systems market the jury could not decide as to whether or not Nintendo willfully acquired or maintained that monopoly power or if Nintendo's licensing agreements were an unreasonable restraint of trade. The failure of the jury to conclude on these issues resulted in the mistrial. The jury did conclude that Nintendo did not have the specific intent to monopolize the U.S. video game market. Atari's President Sam Tramiel said, "Although we did not get a unanimous decision, we did accomplish one of our objectives, the elimination of the exclusivity clause from the Nintendo license agreements. That provision was dropped by Nintendo in December 1990."
 The company is reviewing its legal alternatives at the present time.
