 Phil Wyman, R-Tehachapi, has been charged in a five-count criminal complaint.

Sheriff's deputies said Brooks called Wednesday from out of town and said he wanted to make arrangements to surrender, which will probably happen Friday or Monday, said Sgt. Mike Becker of the North County Family Crimes Bureau.

The charges were filed after a two-week investigation, and an arrest warrant was issued Tuesday with bail set at $195,000, Becker said Wednesday.

The investigation started after prison authorities in Sacramento intercepted a letter sent by Brooks to an inmate INMATE. The letter talked about sexual conduct with boys, including a 7-year-old boy who lives in Brooks' neighborhood, Ebrahim said. No charges have been filed regarding the 7-year-old because of insufficient evidence insufficient evidence n. a finding (decision) by a trial judge or an appeals court that the prosecution in a criminal case or a plaintiff in a lawsuit has not proved the case because the attorney did not present enough convincing evidence. , Ebrahim said.

Further investigation led to the victim named in the complaint, Ebrahim said.

The victim is not a relative but an Antelope Valley youngster who lived at Brooks' home in Quartz Hill, Ebrahim said. Ebrahim declined to say how the boy came to live with Brooks.

Brooks, who is married and has grown children, is an employee of the Assembly Rules Committee. Assembly officials said they have been trying to contact Brooks, but to no avail, and would like to talk to him before taking action.

``We've been trying to contact him for the last 11 days to find out what his status is, to find out if he's going to resign,'' said Jon Waldie, the Assembly's chief administrative officer A chief administrative officer (CAO) is responsible for administrative management of private, public or governmental corporations. If convicted of all charges, Brooks faces 17 years in prison.

He is accused of committing the offenses between March and November 2000, Ebrahim said.

The misdemeanor count refers to images of young boys that were found on Brooks' computer, Ebrahim said.
