ASCAP and Music Choice Announce Agreement on Licensing Fees.

) and Music Choice have entered into a long-term agreement concerning the music performing rights Performing rights are the right to perform music in public. It is part of copyright law and demands payment to the music’s composer/lyricist and publisher (with the royalties generally split 50/50 between the two) when a business uses music in a public performance.  fees for the MUSIC CHOICE(R) digital music service, it was announced today by John A. LoFrumento, Chief Executive Officer of ASCAP and David J. Del Beccaro, President and Chief Executive Officer of Music Choice.

Music Choice is the largest provider of commercial-free digital music via cable and satellite. The agreement covers distribution of the MUSIC CHOICE(R) service in the home via cable, satellite and other media such as the Internet.

LoFrumento noted that "this agreement recognizes that Music Choice values the contribution made by ASCAP members and it assures that these members will be adequately compensated for the performance of their copyrighted musical works."

Del Beccaro said that "Music Choice is pleased to have reached a mutually satisfactory agreement which affirms the notion of fairness and competition within the music service industry while respecting the rights of copyright holders."

This agreement concludes Music Choice's participation in the cable-wide proceeding regarding ASCAP license fees.
