ASAE Files Amicus Brief in NSPI Case.

 filed a brief with the Supreme Court of the State of Washington, urging that it accept an appeal from the National Spa and Pool Institute, Alexandria, Virginia Alexandria is an independent city in the Commonwealth of Virginia. As of the 2000 census, the city had a total population of 128,284. Located along the Western bank of the Potomac River, Alexandria is approximately 6 miles (9.6 kilometers) south of downtown Washington, DC. , in a lawsuit involving an association's liability in the standard-setting arena.

 liable when a teenager sustained serious injury after diving into a swimming pool. The jury found that NSPI was negligent in setting safety standards Safety standards are standards designed to ensure the safety of products, activities or processes, etc. They may be advisory or compulsory and are normally laid down by an advisory or regulatory body that may be either voluntary or statutory.  and therefore must pay $6.6 million to the injured plaintiff. The Washington State Court of Appeals refused to overturn that verdict.

ASAE's brief argues that the courts should not discourage beneficial, voluntary standard-setting activities engaged in by associations. The brief states that "the court should grant review to determine whether private associations performing the quasi-governmental task of standards development are entitled to qualified immunity."
