PALMDALE - Palmdale Councilman Richard Loa has a new post in the Schwarzenegger administration after dropping his bid to be confirmed to the state Board of Prison Terms amid opposition from a key Democratic legislator LEGISLATOR. One who makes laws.

``The governor's appointment office and I decided not pursue the post,'' Loa said. ``I'm delighted to be in the position I'm now serving.''

Loa was named an assistant to the director of the state's House and Community Development Department. The position, which has a salary of approximately $93,000 a year, does not require Senate confirmation.

``When I applied I did not apply for the Board of Prison Terms. It was not my idea to go from dealing with people accused of crimes to dealing with people convicted of crimes, but that was the opportunity,'' Loa said.

Loa left his job as an alternate public defender for the $99,693-a-year prison board post, which sets conditions for inmates' release and decides whether to free prisoners serving life terms.

The Palmdale City Council also changed its meeting nights from Wednesdays to Mondays to accommodate Loa, who was elected to the council in 2001. Loa said there is no need to change the meeting night back.

Attorneys had raised concerns with Burton about Loa's aggressive questioning of inmates. Burton's office did not respond to a telephone request for comment.

``My cross examining was done in a relevant manner in regards to credibility,'' Loa said. ``My first concern was the due-process rights of the inmates. I tried to balance that with the high interest in public safety.''

Loa said in his new post one of his key duties will be to work with cities to ensure they report their housing development plans to the state. About 30 percent of California's cities are now in compliance with state requirements to report their housing plans.
