ARMSTRONG WORLD INDUSTRIES ISSUES STATEMENT

LANCASTER, Pa., Jan. 15 /PRNewswire/ -- In a petition for certiorari filed today with the U.S. Supreme Court, Armstrong World Industries, Inc. (NYSE: ACK), is asking that court to review certain aspects of a decision by the U.S. Court of Appeals for the Third Circuit in a case involving a lawsuit by The Industry Network System (TINS) and its founder against Armstrong.
The appeals court, in its decision October 28, sustained a U.S. District Court decision in the case that the April 1991 jury verdict against Armstrong should not be allowed to stand and that the company is entitled to a new trial. However, it also overturned certain rulings of the District Court in favor of Armstrong, including certain aspects of the judgment notwithstanding the verdict.
The Supreme Court is expected to rule on Armstrong's petition before it ends its present term in June or July of this year. If it grants the petition, the Court will require that the case be scheduled for full briefing and argument.
